Under federal law, the district where the private school is located is responsible for servicing students in private schools. Most states follow this rule, as well as the obligation to provide services via a services plan rather than an IEP.
Some states, however, have different arrangements. For example, here in Massachusetts eligible private school students receive an IEP and the district of residence is the one with the responsibility.
