Mary: What rights cannot be waived? I am Pro Se Parent in settlement discussions with a cyber charter school that is also an LEA. Can a Parent/Guardian waive a student’s future right to attend school and receive services? The LEA is proposing that in exchange for X settlement, I will agree to never return the student to the LEA. Can this right be waived?

  1. It sounds as though this whole settlement process began by you filing for due process and then going to mediation. If so, I would ask the Impartial Hearing Officer that was assigned to your case.

    Note that whether this is possible or not, you may want to think very carefully before signing something like that!
