Paula: My grandson is a special needs student in a self contained room. Our school district LEA refused to let him ride the special bus. Today 2 middle school students got into a fight on the bus and my grandson was hit in the face. He has a knot on his jaw and the doctor said his jaw is fractured. What are our rights concerning special transportation for him? Oh yeah, the bus video camera was conveniently not working and the aide assigned to his bus wasn’t on on it.
Paula, I don’t think the lack of a video is a problem. If he had a broken jaw when he got off the bus, and he didn’t have a broken jaw when he got on — there is clearly a safety issue. You may also want to speak about the effects the incident has had on him, e.g. school refusal, anxiety, etc. Just make sure not to talk about your own anxiety. (That is a conversation to have with a supportive friend, not the district. Speaking from experience.)
You need to find out your state law & rules on transportation. Your state parent training & information center can assist you. http://www.parentcenterhub.org/find-your-center In TX for example educators are only legally liable for maters involving discipline, & transportation. I was once sued for an incident that happened on a bus.
