Heather: My child’s IEP includes OT for executive functioning skills. It has been over a month since the IEP was signed and the school is saying they are still trying to find a provider. How long do they have to find a provider before I can pursue legal action?
Your state may or may not have a rule or timeline on this. You can ask the school to commit in writing to making up all missed services. This is possibly what you would get, if you take legal action.
