Dawn: It seems that there should be a signature section to approve the IEP. The IEP that I received for my son has a signature for Safety Procedures and a signature section for those attending the IEP meeting (which clearly states that you are not agreeing with the IEP by signing), but there is no place to sign that the IEP is agreeable. How is this a legal document if that is not in place?
Is there any case law supporting the challenge of parent signed IEPs, where the school claims the parent agreed with the IEP by signing?
The federal rules do not require signatures, just that the document indicate what the decisions are and whether there was or was not agreement. Your state rules could add to the federal rules.
