Kathy: I have several students who do not have a regular education teacher as part of their academic program. We are required to have a regular education teacher as part of the meeting. Suggestions?

The IDEA says that the IEP team must “include a regular education teacher (if the child is, or may be, participating in the regular education environment”
The Commentary to the IDEA regs says, “The regular education teacher who serves as a member of a child’s IEP Team should be a teacher who is, or may be, responsible for implementing a portion of the IEP so that the teacher can participate in discussions about how best to instruct the child.”
BUT …
The IDEA does not require “a regular education teacher to be part of the IEP Team for a child who is not participating in the regular education environment or is not anticipated to participate in the regular education environment.” [Commentary to the IDEA regs, page 46675]
