Under IDEA, the magic number is 10 – once a student is removed from school for 10 consecutive days or 10 non-consecutive that represent a pattern, he/she is entitled to services (state law or local policy may set another time line).
But that does not stop the parent from asking, or the Team for proposing, to do something sooner. A student’s IEP is supposed to address behavioral issues that impact his/her education.
I encourage you to ask for a meeting with the IEP Team. You can ask that a functional behavioral assessment be completed, and a behavioral plan be developed based on the results.
