Jessica: Need established for tier 111 intervention, but the district curriculum director says materials are not available.
She also says there is no timeline on getting materials for tier III curriculum. He is a 4th grader with dyslexia, dysgraphia and dysnomia. I know there are laws against this but I CANNOT FIND THEM! I have an appt with the school board and need something to cite! Please help!

Both IDEA and NCLB encourage the use of “response to scientific, research-based intervention,” but neither provide individual students with a right to receive instruction through an RTI model (your state may have it’s own rules regarding RTI – check with your Dept of Education).
As your child has already been diagnosed with a disability and the school has identified his as needing tertiary-level intervention, you may consider requesting an initial evaluation for special education eligibility. That will provide you with procedural protections.
