FERPA (the federal student records law) gives parents the right to inspect and review their child’s educational records. Parents also have the right to receive a copy of the records if circumstances prevent them from accessing the records in a timely manner, and when copies of the records are sent to a third party (like an outside evaluator).
Test protocols are considered part of the student’s record if they contain information unique to the child, such as the child’s answers. Under FERPA, therefore, you would have a right to review the protocols (and to receive copies in certain situations).
