Eligibility: OUT OF DISTRICT/BOUNDARY EXCEPTION IEP

b: I found a great school out of district for my child, who attended last year. Child needs IEP but I have been told can’t have one since out of district. Is this true and/or legal?

  1. I would think that this would follow along like it does for private schools. That is, the home district is responsible for the ARD and creating the IEP, but the school they are attending needs to attend and follow but back when we were in private school – they weren’t technically required to follow. However, private schools are one thing, and public schools another, so it would depend on if the school you are considering is public or private.
