Accommodations: TOILETING HELP FOR CHILD WHO “DOESN’T QUALIFY FOR SPECIAL ED SERVICES.”

Amanda:  A 4-year old child has a medical dx of global developmental delay, but does not qualify for educational services based on his FIE from last year. He is ready for Pre-K, but is not toilet trained. Admin says that his parents can bring him to school but have to come up to diaper him throughout the day. Shouldn’t there be a way to provide accommodations? 504 maybe?

  1. I’m in a teacher position at an online school where I handle kindergarten. A family wants to stay with us next year for several reasons… And one of the reasons is the student isn’t potty trained and this the student can’t go to public school. The parents have expressed suspicion of autism, but have gone nowhere with this and are not interested in any plans. (The student does just fine academically)

    While I agree virtual school is an option and I’m just an observer, what responsibility does a public school have for accommodating diapers/pull-ups and the world of potty-training when parents refuse 504s?

    • Section 504 is what would require the school to do this for a student that was not under an IEP. The school might do this without a 504 plan. Or they might do it with a 504 plan that only addressed this. If the school wanted to put more in the plan, the parents could say no, & take him out of school. If the child has Autism, or some other issues, not taking action asap is not a good idea, but you already know that. Good luck.

  2. The school’s position violates 504/ADA(Americans with Disabilities Act). Every district should have a 504/ADA coordinator. This person is more likely than campus staff to know the rules. 504/ADA is enforced by the Office of Civil Rights.
